Seen In Use terms of service

These terms govern a merchant's access to and use of the Seen In Use Shopify app and its related services.

01 / Agreement

Using Seen In Use means accepting these terms.

These Terms of Service form an agreement between the person or business using Seen In Use (the “merchant,” “you,” or “your”) and Kenney Labs (“Kenney Labs,” “we,” “us,” or “our”). By installing, accessing, or using Seen In Use, you agree to these terms. If you use the service for a business or other organization, you represent that you have authority to bind that organization.

If you do not agree, do not install or use Seen In Use. Shopify's terms and policies continue to govern your use of Shopify and are separate from these terms.

02 / The service

Merchant-controlled social proof for Shopify.

Seen In Use lets merchants curate or connect eligible content, associate it with products, and display galleries or feeds through supported Shopify themes. Available features can depend on the plan, provider availability, Shopify capabilities, theme compatibility, account permissions, and service configuration.

We may improve, add, remove, or change features to maintain security, provider compatibility, legal compliance, or product quality. We will not intentionally make a material paid feature unavailable without reasonable notice when notice is practical.

03 / Accounts and authority

You are responsible for authorized access.

You must have authority to install apps for the Shopify store and to grant every permission you approve. You are responsible for the actions taken through your Shopify account, for maintaining the security of that account, and for keeping your store and contact information accurate.

Notify us promptly at hello@kenneylabs.com if you believe Seen In Use has been accessed without authorization.

04 / Plans and billing

Shopify presents and processes app charges.

Paid plans, prices, billing intervals, trials, and material usage terms are shown before you approve a charge through Shopify. Shopify processes app charges under its billing terms. Taxes may apply.

You may change or cancel a plan through the available Shopify and Seen In Use controls. A cancellation or downgrade does not entitle you to a refund for charges already incurred except where required by law or expressly stated when the charge was approved.

05 / Merchant content

Your content remains yours.

You retain ownership of content and information that you upload, select, or authorize Seen In Use to process. You grant Kenney Labs a limited, non-exclusive license to host, copy, transform, cache, and display that content only as needed to operate, secure, support, and improve the service for your store.

You represent that you have the rights, permissions, and lawful basis needed to use the content and to authorize this processing. You remain responsible for the content displayed on your storefront, including claims, disclosures, endorsements, intellectual-property rights, and privacy or publicity rights.

06 / Connected social feeds

You control which authorized accounts are connected.

You represent that you administer, or are authorized to connect, each social account or Page and may display its public content on your store. You remain responsible for the content and for compliance with the connected provider's terms.

Provider availability, permissions, deleted or private content, embeds, and API behavior are controlled by the provider and may change. Seen In Use may hide a feed that cannot be successfully refreshed for 48 hours, that loses authorization, or that is no longer entitled. Cached changes may take up to approximately 12 hours plus five minutes to become visible under normal operation.

Ending Pro hides automatic feeds. Encrypted connections may be retained for up to 30 days solely to allow restoration after an upgrade, after which they are revoked and erased. You can request earlier removal by disconnecting the provider, uninstalling the app, or following the data deletion instructions.

07 / Acceptable use

Use the service lawfully and responsibly.

You must not use Seen In Use to:

  • violate applicable law, another person's rights, or a provider's terms;
  • display unlawful, deceptive, infringing, abusive, or malicious content;
  • circumvent access controls, plan limits, security measures, or provider restrictions;
  • probe, disrupt, overload, reverse engineer, or misuse the service except where applicable law expressly permits it; or
  • introduce malware or use the service to collect data without required notice, consent, or authority.

We may remove content or suspend access when reasonably necessary to prevent harm, address a violation, comply with law, or protect Seen In Use, Shopify, a provider, merchants, or shoppers.

08 / Third-party services

Some parts of the experience depend on others.

Seen In Use interoperates with services such as Shopify, Instagram, Facebook, TikTok, hosting, storage, and content-delivery providers. Their services, terms, permissions, availability, and decisions are outside our control. Kenney Labs is not responsible for a third party's service, content, acts, or omissions.

A provider may restrict or revoke access, alter an API, remove content, or stop supporting a feature. We may modify or discontinue an affected integration if continued operation is no longer practical or lawful.

09 / Privacy and deletion

Data use follows the published notice.

The Seen In Use privacy notice explains the data we process, why we process it, relevant retention, and service providers. The data deletion instructions explain how a merchant or shopper can initiate an applicable request.

10 / Kenney Labs ownership

The service and its technology belong to Kenney Labs.

Except for merchant content and third-party materials, Kenney Labs and its licensors own Seen In Use, including its software, design, documentation, branding, and other intellectual property. These terms give you a limited, non-exclusive, non-transferable right to use the service for your Shopify store while the agreement remains active.

If you provide feedback, you permit us to use it without restriction or compensation, provided we do not identify you publicly without permission.

11 / Disclaimers

The service is provided “as is.”

To the maximum extent permitted by law, Seen In Use is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not guarantee that provider content will remain available or that the service will produce a particular commercial result.

Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

12 / Limitation of liability

Liability is limited where the law allows.

To the maximum extent permitted by law, Kenney Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from Seen In Use or these terms.

To the maximum extent permitted by law, Kenney Labs' aggregate liability arising from Seen In Use or these terms will not exceed the amount you paid for Seen In Use during the twelve months before the event giving rise to the claim. These limits do not apply where applicable law does not permit them.

13 / Suspension and termination

You can stop using Seen In Use at any time.

You may end this agreement by uninstalling Seen In Use and paying any outstanding charges. We may suspend or terminate access if you materially breach these terms, create security or legal risk, fail to pay an approved charge, or if continuing the service is no longer practical. When reasonable, we will provide notice and an opportunity to cure before termination.

Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and accrued payment obligations—will survive. Data handling after termination follows the privacy notice and data deletion instructions.

14 / Changes and contact

Questions are welcome.

We may update these terms to reflect product, provider, legal, or operational changes. We will update the date above and provide additional notice when required by law or when a change is materially adverse. Continued use after revised terms take effect constitutes acceptance to the extent permitted by law.
